Sinking Ship Entertainment Inc., Sinking Ship Interactive Inc., and / or its affiliates (collectively “Sinking Ship”, “we”, “us” or “our”) is a production, distribution and digital media company that creates original children programming.

This privacy policy (the “Privacy Policy”) outlines how Sinking Ship will collect, use, disclose and safeguard your personal information when you access or use our websites (“Websites”) or mobile applications (“Apps”)(collectively our “Sites”), and otherwise interact with our services, including our career portal (“Services”). This Privacy Policy also covers some of our offline privacy practices, for example when you call us. This Privacy Policy only covers the Sites in which this Policy is posted. Some of our websites, apps and services may be subject to a separate, additional policy. We encourage you to read the privacy policies of all websites and apps.

We take the privacy of our users seriously and are committed to safeguarding your personal information. We may update this Privacy Policy without prior notice to you, and any changes will be effective immediately upon the posting of the revised Privacy Policy on the Website, Apple’s App Store or Google Play.

1. Information We Collect

i. Registration and Account Information

When you create an account (“Account”) on the Service we will only collect the following information from you:

  • First Name;
  • Password; and
  • Email address

ii. Career Information

When you apply for a job through our career Service, we will collect the following information from you, including:

  • First and last name,
  • Contact information, including mailing address, telephone number and email
  • Cover letter details
  • Education and career history
  • Other information contained in your resume

iii. Contact Us

When you contact us, for example when you make an inquiry by email or phone, we collect the information you send to us.

We also collect your contact details if you subscribe to receive promotional emails from us, such as our newsletter, invitations and other communications.

iv. Children and Minors

Children under the age of 13 can use the Website and the App.

When a child registers for an Account, we only request that the child enter their first name, a password and their parent’s or legal guardian’s email address. We use this email address to notify the child’s parent or legal guardian that the child has registered for an Account on the Service.

Once a child has registered for an Account, we only request that the child enter their username and password in order to login and play a game on the Website or the App.

If you are under the age of 13, please DO NOT input your full name, your own email address, or include other information that could identify you.

2. Use and Disclosure of Your Information

We will use the personal information that we collect to provide, maintain and improve the Service.

i. Identification and Verification

We collect email addresses to help verify Account information and to inform parents that their child is using the site.

We also collect your contact and other details in order to respond to your inquiry or to send you our promotional emails.

ii. Account Administration

We may use your personal information to communicate with you about the Service and your Account and to provide you with technical support.

iii. Career Evaluation

We will use the personal information and other candidate information you provide solely to create and maintain your personal account, evaluate your application, to contact you in connection with your application, to respond to any inquiry you direct to us, and for other legitimate human resources purposes, such as record-keeping relating to our hiring practices.

iv. Third-Party Service Providers

We may share your personal information to a third-party service provider for processing and storage. For example, we use a third—party online applicant and recruiting platform to assist Sinking Ship’s career portal. Whenever we engage a third-party service provider, we ensure that the information is properly safeguarded at all times at a comparable level of protection the information would have received if it had not been transferred.

We may transfer your personal information to a third-party service provider outside of Canada. In the event that your personal information is transferred outside of Canada, the government, courts or law enforcement or regulatory agencies of that jurisdiction may be able to obtain disclosure of your personal information through the laws of that jurisdiction.

v. Legal Issues

We may use your personal information to detect, investigate, address and prevent fraudulent or illegal activities. We reserve the right to disclose your personal information as required by law, when we believe that disclosure is necessary to comply with a judicial proceeding, court order, or legal process served on us and to defend against legal claims. We may also disclose your personal information to investigate the breach of an agreement.

vi. Corporate Matters

We may disclose and share your personal information to explore and/or undertake a corporate transaction, including a merger, acquisition, amalgamation, IPO, reorganization or sale of Sinking Ship. Your personal information will be used and disclosed solely for the purposes related to the transaction and will be protected by security safeguards appropriate to the sensitivity of the information.

3. Retention of Your Information

So long as your Account remains active, we may preserve your personal information.

We will retain any and all personal information that we are required to retain under any applicable laws for the full duration of time required under those laws.

If you want us to permanently delete your personal information from our servers, please send an email to privacy@sinkingship.ca. We will ensure your information is deleted in a reasonable time after receiving that request.

4. Safeguarding Your Information

Your personal information will be protected by security safeguards appropriate to the sensitivity of the information. We have implemented a SSL certificate on the Website to enable secure encrypted connection with the Website.

5. Third Party Links

For your convenience, our Sites may contain links to third-party websites or applications, such as social media sites. This Privacy Policy does not cover the privacy practices of those sites and Sinking Ship is not responsible for their practices.

6. Google Analytics

Our Sites use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help our Sites analyze how users use the Site and our Services. The information generated by the cookie about your use of the SItes (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Site, compiling reports on website activity for us and providing other services relating to website activity and internet usage. 

Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser.

You can use the Google Analytics Opt-out Tool to opt-out of Google Analytics.

If you wish to verify, correct, or update any of your personal information collected by us you may do so by contacting us at the address in the “How to Contact Us” section below.

Please note that we may request personal information from you in order to authenticate your identity before providing you with access to your personal information or complying with any request to correct or update your personal information.

Please also note that in some cases we may legally deny you access to the information that we have collected about you. For example, this may occur where the information is subject to solicitor-client privilege or consists of references to other persons or proprietary information that cannot be severed.
